General terms and conditions of sale

1. Scope of application
These general conditions of sale apply to all sales concluded on the laboutique.edpsciences.fr website, subject to the specific conditions indicated in the product descriptions.
These conditions may be modified at any time without prior notice by the site administrator.
2. Description of the articles
The website laboutique.edpsciences.fr offers for sale intellectual works in physical versions (in particular printed books), but also in digital versions (e-books, audio books...).
The digital books (or e-books) sold on laboutique.edpsciences.fr are digital files containing intellectual works intended to be downloaded to be read on electronic devices.
Both printed and digital works are protected by French and international copyright laws. In the absence of a licence specifying other conditions of use, the downloaded files are reserved for the exclusive use of the buyer. They may not be resold, rented or transmitted free of charge beyond the family circle and the legitimate needs of private use; any representation or reproduction of these files, in whole or in part, outside the cases provided for in Article L122-5 of the Intellectual Property Code, is strictly forbidden and would expose the holder to legal action.
In order to protect the rights of the authors without restricting the use of the downloaded files by those who have legitimately acquired them, all items purchased on this site are personalised with data from the customer (surname, first name, e-mail address), via a digital mark dynamically affixed to each page or inside the digital file.
3. Orders
All orders are placed exclusively via the laboutique.edpsciences.fr website. Payment is made when the order is placed.
The customer must be at least 18 years old and have legal capacity or parental authorisation to place an order on laboutique.edpsciences.fr.
The click on the "Pay" button on the screen summarising the order and the explicit acceptance of these general terms of sale by a dialogue box, constitute an electronic signature which expressly certifies the customer's unreserved consent to these general terms of sale and to the particular conditions (in particular the unit price) specific to each file purchased. The customer thereby waives the right to invoke any contradictory document, in particular their own general terms of purchase.
The customer may abandon their order up to the moment payment of their order has been validated.
For security reasons, each order basket is limited to a maximum amount of 100.00€ including VAT, and the number of orders per customer is limited to 3 per 7 days. These limits can be modified upon request by the user.
Any order with a fraud risk profile may be blocked by the administrator at the payment stage.
4. Availability of items
The articles are normally available 24 hours a day, 7 days a week and all year round. The administrator of this site reserves the right to temporarily close access to products without notice.
The administrator cannot be held responsible for technical problems beyond their control, such as connection problems due to Internet service providers or computer problems due to the customer's hardware or software.
5. Prices
The prices of the products are deemed to be net prices in Euros, including all taxes and excluding shipping costs for printed works. All orders are invoiced in euros and payable in euros at the time of ordering.
VAT of 5.5% applies to all printed and digital books.
Printed books are sold in compliance with the applicable provisions and more particularly with the Lang Law on the single price of books, the latter, excluding postage, being fixed by the publisher. For all deliveries outside of Metropolitan France, any customs duties or local taxes remain the responsibility of the recipient.
6. Shipping costs
The delivery costs include a contribution to the costs of picking, packaging and postage. They are fixed according to the geographical area.
7. Payment
The price is payable in full and in one instalment when the order is placed.
Payment for purchases is made by credit card via the Paybox system. The bank transaction is carried out at the time of the order.
As soon as the payment method used by the credit card holder has been validated, the order is confirmed and can no longer be cancelled or refunded.
8. Delivery
Regardless of the country of destination, printed works are always delivered to the address indicated at the time of ordering. The delivery time includes time to prepare the parcel plus the transport time by the carrier.
Digital works purchased on this site are delivered by download. A few minutes after payment of the order, an e-mail is sent to the customer with one or more download links for one-time use allowing the works to be loaded onto the customer's computer. These download links have a shelf life of 48 hours. After this period, if the customer has not downloaded the file, they may request a new link to be sent by logging into their laboutique account.
9. Guarantee, refunds et returns
Guarantee on products
The new items supplied on this site are guaranteed against any defect. However, if an item is defective or does not conform, you have 15 days to return the product in its original cellophane packaging or by e-mail if it is a digital product. As soon as we receive the defective item, a new copy will be sent to you if it is a printed work or offered for download for digital works.
Right of withdrawal
For physical items (printed books) you have a right of return. For any reason whatsoever, you can return an item within 15 days of receiving your package (in its original cellophane packaging).
Purchases of digital media are firm and final. They cannot give rise to any exchange, refund or right of withdrawal.

10. Protection of personal data
The information that is requested from the customer is necessary to process orders or to improve the services that can be offered on the site. This information and data are also kept for security purposes in order to comply with legal and regulatory obligations.
The processing of personal data is done in compliance with the law relating to information technology, files and freedoms of 6 January 1978. Any person registered on this site has the right to access and rectify personal data concerning them. To do so, simply access your account or contact us.
In addition, visitors to the site are informed that "cookies" record certain information that is stored in the memory of their hard disk for statistical purposes or to personalise products and services according to previous visits. A warning message may ask the visitor, beforehand, if they wish to accept cookies, which they may, of course, refuse. It is also possible, at any time, to configure your browser to accept or refuse cookies from this site.
These cookies do not contain any confidential information about the visitor and are only used to improve the personalised service provided to the visitor.
11. Responsibility
laboutique.edpsciences.fr declines all responsibility in the event of non-performance of the contract due to a case of force majeure (strike, flood, fire, etc.).
laboutique.edpsciences.fr cannot be held responsible for the content of the sites on which its products are referenced.
The products offered comply with current French legislation. laboutique.edpsciences.fr cannot be held responsible in case of non-respect of the legislation of the country where the product is sent or downloaded. It is the responsibility of the buyer to check with the competent local authorities the legality of using the products ordered.
12. Application law
General conditions of sale are subject to French law. Any dispute shall be brought before the competent courts for the geographical area where the registered office of the administrator of this site is located.
Use of the works
This site provides access to printed books or digital books downloaded to be read on different electronic equipment.
The items purchased in this way, whether printed or digital, are subject to the law on copyright. They are the exclusive property of the purchaser and reserved for private use. Any representation or reproduction of these files, in whole or in part, outside the cases provided for in Article L122-5 of the Intellectual Property Code, is strictly forbidden and would expose the owner to legal action.
